En el marco del derecho de familia vigente, se examina sobre la base de un análisis comparativo de la jurisprudencia nacional, derecho y jurisprudencia extranjera, si reglamentar en nuestro país “la gestación por sustitución” brinda mayor seguridad, igualdad y protección jurídica a las personas que recurren a estas técnicas o se sigue dejando librado a la discrecionalidad judicial el reconocimiento de este derecho fundamental “a intentar ser progenitores en virtud de una de las técnicas de reproducción humana asistida”, para concluir, asumiendo la necesidad de su regulación a los fines de brindar protección y justa composición de intereses de todos los involucrados.
