However, it is feasible to mention a situation that, apparently, would be outside the rule. It will be referred to in the present work. Tomando como punto de partida la regla jurídica que expresa: “Peccata suos teneant auctores”- “Obliguen los delitos a sus propios autores”, contenida en el Libro IX del Código, Título XLVII, denominado “De las Penas”, constitución 221, correspondiente a los emperadores Arcadio y Honorio -año 399- se observa que ese precepto romano está relacionado en nuestro tiempo, con el principio de culpabilidad y el de la personalidad de las penas. Sin embargo, es factible mencionar a una situación que, aparentemente, quedaría fuera de la regla. A ella se hará referencia en el presente trabajo.
