To this end, the generalaspects of the trade union immunity are contextualized from a theoretical perspective in light of the Labor Code, and the trade union immunity process in the light of the Procedural Code of Labor and Social Security, which are presented as the first and second part, respectively. We went to the documentary or content analysis, where we reviewed the legislation that exists in Colombia in this regard; similarly, founded theory was used, understood as a way of doing analysis. Finally, it is concluded that it is necessary to propose strategies that lead to solve the problems currently faced by the judicial sector in Colombia in matters of trade union immunity, in order to promote harmonious labor relations that lead to the good social and economic development of the parts. El propósito de este trabajo consiste en presentar una reflexión acerca de la naturaleza jurídica del fuero sindical en Colombia.Para ello, se contextualiza desde una perspectiva teórica los aspectos generales del fuero sindical a la luz del Código Sustantivo del Trabajo, y el proceso de fuero sindical a la luz del Código Procesal del Trabajo y de la Seguridad social, los cuales son presentados como primera y segunda parte, respectivamente. Se acudió al análisis documental o de contenido, donde se revisó la legislación que al respecto existe en Colombia; de igual forma, se recurrió a la teoría fundada, entendida ésta como un modo de hacer análisis. Finalmente, se llega a la conclusión que es necesario plantear estrategias que conduzcan a resolver los problemas que actualmente afronta el sector judicial en Colombia en materia de fuero sindical, a fin de propiciar unas rela ciones laborales armónicas que conlleven al buen desarrollo social y económico de las partes.
