In general, it has been known as the “third improvement”, because it is a portion that generally constitutes the third of the inheritance and is intended to increase the hereditary portion of any of the descendants (in addition to the quota of strict legitimate, which is usually a legitimate short) and whose distribution, therefore, is unequal. The advantage is that the greater freedom of disposition offered by the improvement with respect to the systems where legal succession withlong legitimate ones predominates, is that it is limited to the legitimate family. And, in addition, an heir could accumulate in addition to the corresponding legitimate portion, the improvement portion and the freely available portion. It can be used to improve offspring who especially need capital to take care of their illnesses, to reward the services provided to the deceased or to continue family assets. Then, this institution of inheritance law will be analyzed since its validity in Visigoth law, its presence in Indian law, the fate it had in the Civil Code, the restoration projects of the institute in Argentina and its survival in some Hispanic Americans countries. La mejora es un instituto sucesorio típico del derecho hispánico, que combina la libertad de testar con la sucesión forzosa. En general, se la ha conocido como el “tercio de mejora”, porque se trata de una porción que constituye normalmente el tercio de la herencia y que está destinada a acrecentar la porción hereditaria de cualquiera de los descendientes (conocida como legítima estricta y que normalmente es una legítima corta) y cuyo reparto, por tanto, es desigual. La ventaja es que la mayor libertad de disposición que ofrece la mejora, respecto de los sistemas donde predomina la sucesión legal con legítimas largas, es que se limita a la familia legitimaria. Y, además, un heredero podría acumular además de la porción legítima correspondiente, la porción de mejora y la porción de libre disposición. Puede utilizarse para mejorar a los descendientes que necesiten especialmente de un capital para atender sus enfermedades, para premiar los servicios prestados al causante o para continuar los bienes familiares. Se analizará, entonces, esta institución del derecho de sucesiones desde su vigencia en el Derecho visigodo, su presencia en el derecho indiano, la suerte que tuvo en el Código Civil, los proyectos de restauración del instituto en la Argentina y su pervivencia en algunos países hispanoamericanos.
