The dynamic that observed in recent years the social and solidarity segment in Argentina and Brazil is part of this trend. The development of social and solidarity field in these two national scenarios installed in their societies the debate on the need to deepen the legal regulation of the sector. Taking this into account, this paper tries to characterize the current situation of the legal regulation of the social and solidarity economy in Brazil and Argentina as a central piece of the institutionalization process, highlighting the main aspects of the respective legal frameworks. The study shows that the absence of a specific federal law in the two States was not an obstacle to the development of provincial regimes for social and solidarity economy. Con diferencias de matices en lo referente a los fundamentos que la explican y a los fines que la impulsan, la economía social y solidaria fue adquiriendo, en las últimas décadas, una creciente relevancia en las sociedades de los países sudamericanos. La dinámica que observó en los últimos años el segmento social y solidario en Brasil y en Argentina se inscribe dentro de dicha tendencia. El desarrollo del ámbito social y solidario en estos dos escenarios nacionales instaló en sus sociedades el debate sobre la necesidad de profundizar en la regulación legal del sector. Teniendo en cuenta ello, en este trabajo se procura caracterizar el estado actual que exhibe la regulación jurídica de la economía social y solidaria en Brasil y en Argentina, en tanto faceta central del proceso de institucionalización, resaltando los principales aspectos que observan los respectivos marcos legales. El estudio permite advertir que la ausencia de una ley nacional específica en los dos Estados no fue un obstáculo para el desarrollo de regímenes provinciales sobre economía social y solidaria.
