To delimit the scope of the constitutionalprocess, and set the scope of the benefits to be covered under the Mandatory MedicalPlan, requires that legal operators exercise extreme precautions to protect the right tohealth, and prevent the excessive granting of resolutions in favour of amparists. La acción de amparo regulada en el artículo 43 de la Constitución Nacionales el medio judicial idóneo para que las personas obtengan medicamentos y tratamientosde alto costo ante las negativas de las obras sociales, mutuales o empresas de medicina.Delimitar el alcance del proceso constitucional, y fijar los alcances de las prestaciones acubrir conforme el Plan Médico Obligatorio, requiere que los operadores jurídicos debanextremar los recaudos para proteger el derecho a la salud e impedir el otorgamientoexcesivo de resoluciones a favor de los amparistas.
