To achieve this task, the contributions of the analytical philosopher John Searle are presented, especially those related to the theory of deontic powers based on his studies of language, philosophy of mind and social ontology, in order to unveil nature biopragmatic of the fundamental rights. In this sense, it goes on to show that language, intentionality and consciousness are necessary conditions for the existence of the human rights, their institutionalization and constitutionality, which shows that the ontology of these rights has both biological (natural) and social elements. El presente artículo presenta los resultados de un estudio analítico en torno a la naturaleza de los derechos humanos, con el fin de aportar una posible salida al dualismo ontológico que se presenta en la discusión Iusnaturalismo vs. Iuspositivismo. Para lograr tal cometido se presentan los aportes del filósofo analítico John Searle, en especial los que competen a la teoría de los poderes deónticos sustentada en sus estudios del lenguaje, la filosofía de la mente y la ontología social, con el fin de develar la naturaleza biopragmática de los derechos fundamentales. En este sentido, se pasa a mostrar que lenguaje, intencionalidad y conciencia son condiciones necesarias para la existencia de los derechos humanos, su institucionalizacióny constitucionalidad.
