We analyze two institutions: filiation and parental responsibility. First, we describe how these institutions evolved until the entry into force of the new Civil and Commercial Code of the Nation, to delimit the contributions that the new legislation grants to the community in response to the constitutional mandates, to conclude that it becomes operational the constitutional principle of autonomy of the will. Finally, the reception of this principle in national and international doctrine and jurisprudence is investigated. En el marco del derecho de familia vigente se examina si el principio de la autonomía de voluntad en las relaciones entre progenitores e hijos se encuentra plasmado en el nuevo Código Civil y Comercial de la Nación, y si este armoniza con lo dispuesto en la Constitución Nacional y tratados internacionales de derechos humanos. Analizamos dos instituciones: filiación y responsabilidad parental. En primer lugar, describimos cómo evolucionaron estas instituciones hasta la entrada en vigencia del nuevo Código Civil y Comercial de la Nación, para delimitar los aportes que la nueva legislación otorga a la comunidad en respuesta a las mandas constitucionales, para concluir que el mismo torna operativo el principio constitucional de autonomía de la voluntad. Finalmente, se investiga la recepción de este principio en la doctrina y jurisprudencia nacional e internacional.
