In this regard, the proposal of this paper is to critically analyze a judicial decision at the end of 2012 in Córdoba, Argentina. This judicial sentence conceded the request for transfer of a trans woman, that was in the men’s prison, to the women’s prison. From this legal and social fact, I propose analyze some dimensions about the impact of gender identity law of Argentina in the context of prison confinement. Los análisis jurisprudenciales requieren, cada vez más, un esfuerzo por pensar de un modo interdisciplinario la cuestión social que implica al derecho. En este sentido, la propuesta de este artículo es analizar críticamente un fallo de fines de 2012 en Córdoba, Argentina. Dicho fallo concede el pedido de traslado de una mujer trans alojada en el penal de varones a la cárcel de mujeres. A partir de este hecho jurídico-social, analizamos algunas dimensiones que permiten reflexionar sobre el impacto de la ley de identidad de género de la Argentina en el contexto de encierro carcelario.
