This situation is more complex in conflicts of indigenous peoples because of the structural exclusion once supported institutionally. El presente artículo estudia los nuevos desafíos de los tribunales de justicia originados a raíz del surgimiento de una nueva forma de Estado denominada Estado Constitucional de Derecho que, debido a la centralidad puesta en la Constitución Nacional y los Tratados de Derechos Humanos, obliga al juez a analizar la ley en función del cumplimiento de los principios constitucionales y lo desafía a adoptar nuevas formas de razonamiento y nuevas acciones encaminadas a la garantía de los mismos. Esta situación que se ve aún más complejizada en los conflictos de los pueblos indígenas a causa de su exclusión estructural, otrora avalada institucionalmente.
