However, the Committee on Freedom of Association, in ruling on the legislative act 01 of 2005, noted that collective agreements contain clauses on pensions are valid beyond the July 31, 2010, must maintain their effects until expiration of the term. In conclusion, we can say that pensions enshrined in collective labor agreements, are effective after July 31, 2010 and until the convention is in force or until workers decide to denounce it or replace it with another El acto legislativo 01 de 2005 indicó que las reglas de carácter pensional contenidas en pactos, convenciones colectivas de trabajo, laudos o acuerdos válidamente celebrados perderían vigencia el 31 de julio de 2010. Por tal razón, los beneficiarios de las pensiones anteriores no han podido disfrutar de ellas con posterioridad a la fecha de la referencia. Sin embargo, el Comité de Libertad Sindical de la OIT, al pronunciarse sobre el acto legislativo 01 de 2005, señaló que los convenios colectivos que contienen cláusulas sobre pensiones, cuya vigencia va más allá del 31 de julio de 2010, deben mantener su efectos hasta su vencimiento. En conclusión, podemos afirmar que las pensiones consagradas en Convenciones Colectivas de Trabajo, tienen vigencia después del 31 de julio de 2010 y hasta que se encuentre vigente la convención o hasta que los trabajadores decidan denunciarla o sustituirla por otra.
