Estudiar el procedimiento judicial romano es conocer en su forma cabal el derecho de Roma. De manera que ese estudio, lejos de ser una discusión "arqueológica" sin sin finalidades positivas, resulta un elemento de primer orden para esclarecer los conceptos fundamentales del derecho.Esto se evidencia de una manera tangible en el derecho primitivo, puesto que ahí el mecanismo procesal se compenetra e identifica casi con la misma ley.
