The reason, perceptible without much effort, is that South American legislation does not have an aboriginal root in many of its aspects. By this we do not mean that we think that the legislation of the countries of South America is totally invaded by exotic legislative problems, lacking in national historical reality. Rather, our statement only has in view, almost in general, the purely legislative aspect of the matter; that is, the juridical regulation of national problems. But, notwithstanding the limits of the observation we make here, the fact is of importance for the juridical life of these states, since, frequently, the legislative technique has a deforming influence on the historical substance that it regulates. Si se nos pidiera un ejemplo de países en los cuales la influencia legislativa extranjera resulta evidente, no titubearíamos en indicar a los de Sud América, y, entre ellos, colocaríamos en un puesto de honor a la República Argentina. La razón, perceptible sin mayor esfuerzo, es que la legislación sud-americana no tiene una raíz aborigen en muchos de sus aspectos. Con esto no queremos decir que pensemos que la legislación de los países de la América del Sud, está totalmente invadida por problemas legislativos exóticos, carentes de realidad histórica nacional. Sino que nuestra afirmación sólo tiene en vista, casi en general, el aspecto puramente legislativo del asunto; esto es, la regulación jurídica de los problemas nacionales. pero, no obstante los límites de la observación que aquí hacemos, el hecho resulta de importancia para la vida jurídica de esos estados, pues, con frecuencia, la técnica legislativa tiene una influencia deformatoria de la substancia histórica que regula.
