"Hacia una nueva solución en materia de responsabilidad civil" is the title of his essay, published in the Boletín del Instituto de Derecho Civil (Year VII, W. 2-3). The aim he pursues, to limit the consequences to be remedied, is undoubtedly a reasonable and firm aspiration compared to the traditional one of the French Code, confirmed by that of the German law of the nineteenth century. The author proposes that the French formula that ''anyone who through his fault causes damage to another must repair it'' be replaced by another, more subjectivist formula that, seeking the punishment of the perpetrator of the act, distinguishes the cases in which there is malice from those in which there is only fault. En procura de una nueva posición de justicia, en materia de responsabilidad civil, el Profesor Ernesto Cordeiro Alvarez ha expuesto, nuevamente, el criterio que propugnara en el Primer Congreso Nacional de Derecho Civil, realizado en el año 1927. "Hacia una nueva solución en materia de responsabilidad civil" es el título de su ensayo, aparecido en el Boletín del Instituto de Derecho Civil (Año VII, W. 2-3). La finalidad que persigue, limitar las consecuencias que deben ser reparadas, es, sin duda, una aspiración razonable y firme frente a la ya tradicional del Código francés, confirmada por la del derecho alemán del mil novecientos. El autor propone que la fórmula francesa de que ''todo aquél que por su culpa ocasione un daño a otro debe repararlo'' sea substituída por otra, más subjetivista que, buscando el castigo del autor del hecho, distinga los casos en que hay dolo de aquéllos en que sólo hay culpa.
