This work proposes to reflect on the community experiences of the members of the "Los Chuschagasta" community of the Diaguita people-nation in Tucumán (Choromoro Valley, Argentina) before indigenist laws, attacks, evictions and other situations of persecution by landowners in complicity with state officials, mainly local. Specifically, I focus on two situations of judicial processes that went through the community as it was at the time of its formation, towards the end of the nineties and the first years of the following decade, and then before the murder of one of its authorities, Javier Chocobar, on October 12, 2009. The election of these practices consists of triggered from situations of territorial conflicts that led to the comuneros had to explain and claim their identity and right to territory and, leading to judicialization processes, gave rise to an instance of resignification of the state institutional-legal framework with its body of indigenist laws. Thus, indigenous forms of struggle that combine part of the neoliberal hegemonic logics are evident from a reflective exercise of identity self-recognition that leads the comuneros to think about their daily and ancestral practices according to the normative hegemonic language, not without resignifying it. and, at times, question it. |

Este trabajo propone reflexionar en torno a experiencias comunitarias de los miembros de la comunidad “Los Chuschagasta” del Pueblo-nación Diaguita en Tucumán (Valle de Choromoro, Argentina) ante leyes indigenistas, ataques, desalojos y otras situaciones de persecución por parte de terratenientes en complicidad con funcionarios estatales, principalmente locales. Específicamente, me aboco a dos situaciones de procesos judiciales que atravesó la comunidad como fue al momento de su conformación, hacia fines de la década de los noventas y primeros años de la década siguiente, y luego ante el asesinato de una de sus autoridades, Javier Chocobar, el 12 de octubre de 2009. La elección de estas prácticas consiste en se desencadenaron a partir de situaciones de conflictos territoriales que llevaron a que los comuneros tuviesen que explicitar y reivindicar su identidad y derecho al territorio y, al desembocar en procesos de judicialización, dio lugar a instancias de resignificación del marco institucional-jurídico estatal con su cuerpo de leyes indigenistas.Se evidencian así formas alternas- indígenas de lucha que combinan parte de las lógicas hegemónicas neoliberales, a partir de un ejercicio reflexivo de auto-reconocimiento identitario que lleva a los comuneros a pensar sus prácticas diarias y ancestrales en función del lenguaje normativo hegemónico, no sin resignificarlo y, por momentos, cuestionarlo.
