For this purpose, we review sentences from different courts of the country from 2013 to 2018 and found that the principle of the best interests of the child is the main argument for authorizing a practice that is not regulated in Argentine law. En este trabajo analizamos la aplicación e interpretación de la Convención sobre los Derechos del Niño – específicamente el principio del interés superior- en la jurisprudencia argentina sobre gestación por sustitución. A tal fin examinamos los fallos de distintos tribunales del país en la materia de 2013 a 2018 y damos cuenta que el principio del interés superior del niño consagrado en la normativa internacional ha sido uno de los principales argumentos para hacer lugar a una práctica que no está regulada en nuestro país Facultad de Derecho.
