This multiscalarity manifests itself in various aspects, such as the distribution of institutional responsibilities and powers, the strategies of actors, and the distribution of benefits or damages resulting from the exploitation of the environment. In federal systems, scale dynamics are further complicated by the fact that the subnational level usually has certain prerogatives over environmental issues. In particular, the provincial domain over natural resources and the environmen tal sphere is a very characteristic feature of Argentine federalism. This paper analyzes the game of scales triggered by the judicialization strategies of a specific episode of environmental conflict in a federal context: The cyanide water spills at the Veladero mine in the province of San Juan, Argentina, in 2015, 2016 and 2017. It is argued here that the judicialization strategies deployed by environmental incidents in a federal system combine bottom-up, top-down, and freezing movements, triggering a game of non-linear, uncertain, and eminently unequal scales. Las disputas en torno a las múltiples escalas de acción y de decisión son una de las principales características de la cuestión medioambiental. Esta multiescalaridad se manifiesta en distintos aspectos, como el reparto de responsabilidades y facultades institucionales, las estrategias de los actores y la distribución de beneficios o daños derivados de la explotación ambiental. En los sistemas federales, además, las dinámicas de escala se vuelven más complejas dado que el nivel subnacional suele poseer determinadas prerrogativas sobre las cuestiones medioambientales. Particularmente, el dominio provincial sobre los recursos naturales y el ámbito ambiental es un rasgo muy característico del federalismo argentino. Este trabajo analiza el juego de escalas desencadenado por las estrategias de judicialización de un episodio concreto de conflicto ambiental en un contexto federal: Los derrames de agua cianurada en la mina Veladero en la provincia de San Juan, Argentina, en 2015, 2016 y 2017. Se argumenta aquí que las estrategias de judicialización producidas por incidentes ambientales en un sistema federal combinan movimientos de tipo ascendente («bottom-up»), descendente («top-down») y de congelamiento («freezing») y desencadenan un juego de escalas no lineal, incierto y eminentemente desigual.
