description The socio-affective function in family ties historically, the concept of family in Argentine society has been framed within a structured vision, represented in a single social model of family that was understood as a duty. What did not fit within that structure or brief vision of the family was outside the law and the norms of the Civil Code in Argentina. And, what were the characteristics that this family had? The determining element was biological; blood determined the constitution of a family and the birth of many rights. Although affection always existed in human relationships, it was never a determining element for the law as consanguinity was. Families are complex structures that cannot be reduced to just a biological fact. The central aspects of the classic definition of the family (sexuality, procreation and coexistence) underwent important transformations over the years. The maternal function and the paternal function exceed their merely genetic function, introducing the cultural and social dimension to the concept of families. The Civil Code, in its 2015 reform, incorporates equal marriage, expanding the maternal-paternal binary in filiation and is considered the “right of families”, contemplating its diversity, replacing its traditional name “family law”. The socio-affective standard today becomes, along with the legal and biological ones, a new criterion for establishing the parental bond. The notion of socio-affectiveness is linked to the dynamic face of identity, in relation to having a name, a nationality, knowing one's mothers and fathers and being cared for by them.

Históricamente, el concepto de familia en la sociedad argentina ha estado enmarcado dentro de una visión estructurada, representada en un único modelo social de familia que era entendido como un deber ser. Lo que no encuadraba dentro de esa estructura o visión escueta de familia, quedaba por fuera del derecho y de las normas del Código Civil en Argentina. Y, ¿cuáles eran las características que reunía esta familia? El elemento axial era el biológico, la sangre determinaba la constitución de una familia y el nacimiento de muchos derechos. Si bien el afecto siempre existió en las relaciones humanas, nunca fue un elemento determinante para el derecho, como si lo fue la consanguinidad. Las familias son estructuras complejas, que no se pueden reducir solo a un hecho biológico. Los aspectos centrales de la definición clásica de la familia (sexualidad, procreación y convivencia), sufrieron importantes transformaciones a lo largo de los años. La función materna y la función paterna exceden su función meramente genética e introducen la dimensión cultural y social al concepto de familias. El Código Civil en su reforma de 2015, incorpora el matrimonio igualitario, amplia  lo binario materno-paterno en la filiación y considera el “derecho de las familias”, al contemplar su diversidad, en reemplazo de su denominación tradicional “derecho de familia”. El estándar socioafectivo se torna hoy, al lado de los jurídicos y biológicos, un nuevo criterio para establecer el vínculo parental. La noción de socioafectividad se enlaza con la faz dinámica de la identidad, en relación con tener un nombre, una nacionalidad, a conocer a sus madres, a sus padres y a ser cuidado por ellas y ellos.
