Following the method of analysis of various cases, –which the authors have come to know as a result of our professional activity–, we have chosen three representative cases from which we try to demonstrate the postulate of this work, which is none other than to point out the importance of the positive and proactive actions of the state operators to enforce the rights enshrined in international, national and local regulations. The national State is fully responsible, based on signed international commitments, in the event that these basic human rights are not fulfilled. But it is the state agents (employees and officials of the different agencies) who can make the difference when it comes to citizens' full enjoyment of the rights that the law –in a broad sense– recognizes. El presente trabajo aborda las particularidades del acceso al derecho a la asistencia, en relación a las personas que tienen o han tenido algún conflicto con la ley penal. Siguiendo el método de análisis de diversos casos, –que las/os autoras/es hemos conocido en función del ejercicio de nuestra actividad profesional–, hemos elegido tres casos representativos a partir de los cuales se intenta demostrar el postulado de este trabajo, que no es otro que señalar la importancia que adquieren las acciones positivas y proactivas de las/os operadoras/es estatales para hacer valer los derechos consagrados en la normativa internacional, nacional y local. El Estado nacional es plenamente responsable, a partir de los compromisos internacionales firmados, en caso de que no se cumpla con estos derechos humanos básicos. Pero son las/os agentes estatales (empleadas/os y funcionarias/os de las distintas agencias) quienes pueden marcar la diferencia a la hora de que la ciudadanía alcance concretamente el pleno goce de estos derechos que la ley –en sentido amplio– les reconoce.
