It is based on a critique of the so-called "fiscalist" theory of the colonate, in order to prioritize an approach that gives prominence to the autonomous development of social relations between the peasantry and the aristocracy, within the framework of the private economy. It is concluded that only a posteriori the state provided legal coverage to these relations, observable in the tax legislation on colonate. Se aborda en este trabajo las relaciones entre estado y aristocracia en el Imperio Romano a partir del estudio del colonato tardío. Se parte de una crítica de la así llamada teoría “fiscalista” del colonato, para en su lugar priorizar un enfoque que dé preeminencia al desarrollo autónomo de relaciones sociales entre el campesinado y la aristocracia, dentro del marco de la economía privada. Se concluye que solo a posteriori el estado brindó una cobertura legal a estas relaciones, observable en la legislación fiscal sobre el colonato.  Centro de Estudios Históricos Profesor Carlos S. A.
