In the first case addressing the application of his knowledge about law and his political ideas in the service of the presentation and defence of projects relating to financial bonds between the Nation and the Province and the provincial executive authority in criminal matters, both revealing the value assigned to the need to strengthen the architecture of the State on the basis of the Constitution. In the second case, it is the analysis of his arguments before a verdict of the National Supreme Court of Justice, which decapitated the Education Law of the Province and which  stressed, inter alia, respect for the separation of powers contained in constitutional text. El trabajo se refiere a la actuación parlamentaria de Roque Saenz Peña en la provincia de Buenos Aires y a su desempeño como abogado defensor del Consejo de Educación de esa misma provincia entre mediados de la década de 1870 y comienzos de la siguiente. En el primer caso se abordará la aplicación de sus conocimientos de jurista y sus ideas políticas puestos al servicio de la presentación y defensa de proyectos relativos a las relaciones financieras entre la Nación y la Provincia y a atribuciones del Poder Ejecutivo provincial en materia penal, reveladores del valor que asignó a la necesidad de consolidar la arquitectura del Estado sobre el fundamento de la Constitución. En el segundo, se trata del análisis de su argumentación ante un fallo de la Corte Suprema de Justicia de la Nación, que decapitó la ley de Educación de la Provincia y donde subrayó, entre otros elementos, el respeto a la división de poderes contenida en el texto constitucional.
