In criminal legal dogmatic it is discussed if that homicidal action can be justified by the cause of the state of necessity. Based on respect for life (as a maximum, immeasurable legal good), freedom (no one can be used as a mere means to an end) and equality (no life is worth more than another), it is questioned that, in those cases, it is possible or morally correct to identify a preponderant interest, which is typical of the institute of reference: greater harm to avoid. This article attempts to reproduce the main arguments of that discussion and provide reasons to argue that, in tragic cases, it is possible to build a preponderant interest whose preservation justifies the homicidal action. ¿Es correcto matar inocentes para salvar un número mayor de ellos? En la dogmática penal se discute respecto de si esa acción homicida puede justificarse por la causa del estado de necesidad. Tomando como base el respeto a la vida (como bien jurídico máximo, inconmensurable), la libertad (nadie puede ser utilizado como un mero medio para un fin) y la igualdad (ninguna vida vale más que otra), se cuestiona que, en esos casos, sea posible o moralmente correcto identificar un interés preponderante, que es propio del instituto del derecho de referencia: mal mayor a evitar. Este artículo intenta reproducir los principales argumentos de esa discusión y brindar razones para sostener que, en casos trágicos, sí es posible la construcción de un interés preponderante cuya preservación, justifique la acción homicida.
