The lack of an association in both countries regulating their functions entails some major drawbacks such as the lack of agreed technical guidelines and of consensus on translation rates. Starting from the normative framework regulating the membership to the Spanish association of translators and interpreters and from the information gathered from several Italian courts, we have managed to outline the principles, characteristics, responsibilities and duties underlying this profession. El presente trabajo se postula como un espacio de reflexión acerca de la profesión de traductor jurado y su regulación en los sistemas jurídicos español e italiano. La falta de un Colegio en ambos países que regule la función de la misma implica el descuido de aspectos tales como una homologación en su ejecución técnica o la falta de consenso en las tarifas. Tomando como ejemplo la normativa relativa al acceso del cuerpo de Traductores e Intérpretes del Estado español y la información correspondiente a diversos tribunales italianos, hemos delineado la regulación y las características que subyacen en dicha profesión, así como sus responsabilidades y cometidos.
