The contribution intends to offer an examination of the multiform variety of algorithms, identify their nature and try to build a “merit screen” for intelligent systems. It moves from the ontological analysis of systems (legal and electronic) to arrive at the inseparable dichotomy “legal values-algorithmic variables”. Furthermore, it tries to investigate, through concrete examples, what should be the functionalization of the new artificial intelligence systems and what, instead, should be the principles on which an AI, ethically and personalistically oriented, must be founded. Finally, it arrives at a responsible statute of intelligent systems and new civil configurations which, in the very runaway era of AI, must be addressed to the promotion and protection of the human person and its intimate dignity. |

La contribución tiene como objetivo ofrecer un examen de la variedad multifacética de algoritmos, identificar su naturaleza y tratar de construir una "selección de mérito" para sistemas inteligentes. Pasamos del análisis ontológico de los sistemas jurídicos y electrónicos a llegar a la inseparable dicotomía "valores jurídicos-variables algorítmicas". Además, tratamos de profundizar, a través de ejemplos concretos, en lo que debe ser la funcionalización de los nuevos sistemas de inteligencia artificial y cuáles, en cambio, deben ser los principios en los que debe basarse una IA orientada ética y personalmente. Finalmente, llegamos a un estatus responsable de sistemas inteligentes y nuevas configuraciones civiles que, en la era galopante de la IA, deben dirigirse a la promoción y protección de la persona humana y su dignidad íntima.La contribución pretende ofrecer un examen de la variedad multiforme de algoritmos, identificar su naturaleza y tratar de construir una "pantalla de mérito" para sistemas inteligentes. La contribution entend proposer un examen de la variété multiforme des algorithmes, identifier leur nature et tenter de construire un « écran de mérite » pour les systèmes intelligents. Elle part de l'analyse ontologique des systèmes (juridiques et électroniques) pour arriver à la dichotomie indissociable « valeurs juridiques-variables algorithmiques ». En outre, il tente d'étudier, à travers des exemples concrets, quelle devrait être la fonctionnalisation des nouveaux systèmes d'intelligence artificielle et quels devraient être, au contraire, les principes sur lesquels une IA, orientée éthiquement et personnalistement, doit être fondée. Enfin, il arrive à un statut responsable des systèmes intelligents et des nouvelles configurations civiles qui, à l'ère très galopante de l'IA, doivent s'adresser à la promotion et à la protection de la personne humaine et de sa dignité intime. Il contributo intende offrire una disamina della multiforme varietà degli algoritmi, individuarne la natura e cercare di costruire un “vaglio di meritevolezza” per i sistemi intelligenti. Si passa dall’analisi ontologica degli ordinamenti (giuridico ed elettronico) per approdare alla dicotomia inscindibile “valori giuridici-variabili algoritmiche”. Inoltre, si cerca di approfondire, attraverso esempi concreti, quale debba essere la funzionalizzazione dei nuovi sistemi di intelligenza artificiale e quali, invece, debbano essere i principi sui quali una I.A. eticamente e personalisticamente orientata debba fondarsi. Infine, si perviene ad uno statuto responsabilistico dei sistemi intelligenti e a nuove configurazioni civilistiche che, nell’era quanto mai galoppante dell’I.A., vanno indirizzate alla promozione e alla tutela della persona umana e della sua intima dignità. A contribuição pretende oferecer um exame da variedade multiforme de algoritmos, identificar sua natureza e tentar construir uma “triagem de mérito” para sistemas inteligentes. Passa da análise ontológica dos sistemas (jurídicos e eletrônicos) para chegar à inseparável dicotomia “valores jurídicos-variáveis algorítmicas”. Além disso, procura investigar, através de exemplos concretos, qual deve ser a funcionalização dos novos sistemas de inteligência artificial e quais devem ser os princípios sobre os quais deve assentar uma IA orientada de forma ética e personalista. Por fim, chega-se a um estatuto responsável dos sistemas inteligentes e das novas configurações civis que, na própria era descontrolada da IA, devem estar voltados para a promoção e proteção da pessoa humana e de sua dignidade íntima.
