description The purpose of this article is to read the criminalization of abortion from the contributions of Michel Foucault and Rita Segato. The control of the body impliesdisciplinary power and goes through the construction of arguments against the legalization of abortion. We understand its criminalization as a strategy of such power. This exercise in the control of the bodies according to the social ladder that we occupy according to our gender. In this sense, various social groups and feminist movements put on the public agenda the patriarchal and androcentric oppression that has dominated throughout history over women.Initially, it intended to identify the historical facts related to abortion in Argentina through the description of past and present laws and the social division that generated the legislative discussion on legalization in 2018. The legislation about abortion has been in our country for more than a century; three facts mark it, namely: first, its history dates back to 1886 with the sanction of the first Criminal Code where the prohibition achieves all cases. Second, it is not until 1921 that some caveats are established regarding their penalty: risk of death, rape or diminished mental capacity. Third, a hinge event occurs in2012 with the F.A.L. incorporates -in the concept of health- physical, psychic, social aspects and clarifies that the danger of health may be potential. In the last decade, the fight for the decriminalization of abortion takes a relevant role in the social agenda and reaches its greatest diffusion in 2018 where there is a great social movement.In a second moment, we seek to visualize the implications of the disciplinary power in the control of the woman's body by reconstructing the arguments against the legalization of abortion. The disciplinary power thoroughly captures the body, gestures and behavior. Throughout the history of our society, patriarchy has been the regulatory entity of social organization. Women have found ourselves traversed by a norm of oppression about our daily lives. They consider inferior the feminine and dissident gender -heteronormal discourse-. Two arguments are related to the criminalization of abortion: First, the one who considers the romantic idea -patriarchal- of motherhood where it is considered that the pregnant body and fetus are two independent beings, linked to this that the purpose of sexuality is reproduction. Second, gender stereotypes that establish modes of relationship between people and are a normalizing discourse under the wing of the patriarchal norm in our culture.We believe that disciplinary power goes through our daily actions and seeps into our discourse as a means of discipline. We intend to cut with this discourse - which currently has binary bases - through the deconstruction of gender that allows us to see beyond the stereotypes of man-woman, male-female.

La finalidad del presente artículo consiste en leer la criminalización del aborto desde los aportes de Michel Foucault y Rita Segato. El control del cuerpo que implica el poder disciplinario atraviesa la construcción de argumentos en contra de la legalización del aborto. En un primer momento se pretende identificar los hechos históricos relacionados al aborto en Argentina por medio de la descripción de legislaciones pasadas y presentes en nuestro país y de la división social que generó la discusión legislativa sobre la legalización en el año 2018. En un segundo momento se busca visualizar las implicancias del poder disciplinario en el control del cuerpo de la mujer por medio de la descripción de las características del control del cuerpo y la reconstrucción de argumentos en contra de la legalización del aborto desde esta perspectiva.
