Lowering the age of criminal responsibility is a hardening of the juvenile penalty, therefore, a form of punishment. From Foucault's considerations regarding his conception of delinquent and punishment, we identify the philosophical assumptions that underlie the purpose of lowering the age of imputability. It focuses on the conception of the offender as an enemy of an ideal society to which power wants to monitor, control and discipline. Defining a just desirable population, by contrast, it is possible to define everything that could hinder its development and attack it through its devices. We can understand how power always acts according to its interests, wanting to manage the population's development, permeating all spheres, from legal to everyday life.In any argumentative theoretical development, we can identify an ontology and conception of the world. It is possible to elucidate different conceptions of human being that appear both in Law and in Psychoanalysis. The Law handles a series of hypotheses referring to the human being that, in reality, cannot empirically tested. For example, considering man as a rational being capable of calculating the advantages of his acts. It implies, he is free to choose his behaviors, hedonistic, seeks pleasure and fears suffering, so he can be intimidated, learn from his own experience and of others and, finally, he knows the law and its sanctions, therefore, the supposed ignorance of the law does not mean an attenuator. For Psychoanalysis, man is not always rational, his behavior has unconscious motivations related to intra psychic conflicts and that he is not always hedonistic, he can be selfdestructive since he has instincts that go against his own well-being.In the case of a hardening in penalty, there is a model of human being, a concept of punishment and with it its purpose. Therefore, the question here refers to how the assumptions that appear based on the punishment is present in any penalty claim. To get closer to our objective, we will describe the arguments in favor of the withdrawal in order to clarify that behind them is the disciplinary power of which Michel Foucault speaks. A logic of conception of the world that leads to intervene on the subject -conceived in a certain wayto obtain certain results. What is in question is the conception of the world what underliesand intervene in a disciplinary way in the name of prevention and the fight against insecurity. En el presente trabajo se estudia cómo influyen los supuestos filosóficos que fundamentan el castigo de acuerdo al desarrollo del poder disciplinar de Foucault, en el debate sobre la baja de edad de punibilidad. Se defiende la hipótesis de que dichos supuestos filosóficos subyacen a toda propuesta de penalidad. En primer lugar, se elucidan los supuestos que aparecen en el concepto de castigo en las obras Vigilar y Castigar y La sociedad Punitiva de Foucault. En segundo lugar, se elucidan los argumentos a favor de la baja de edad en la nueva propuesta de ley penal juvenil.
