The combination of global and local laws limits productive autonomy by promoting changes that foster dependency, favours the transnationalisation of agrarian systems, and restrict peasant practices. Capital's new offensive "includes, incorporates, intervenes and transforms individuals according to capital's logic" while maintaining certain coordinates of control (Giraldo, 2018, 85). The Ecuadorian case is used to illustrate the role of legislation in the development and refinement of these inclusion schemes. It shows how contract farming has moved from being a private initiative to being part of public policy, and how regulations on seeds, sanitary and phytosanitary measures have become tools to control food production - planting, growing, processing and marketing - and to limit the diverse options that remain or emerge from peasant creativity. Siguiendo la metodología analítica de los regímenes agroalimentarios (Mc Michael, 2015) este ensayo hace un recorrido histórico político para indagar sobre el rol que juegan las leyes para mantener la hegemonía del capital y despojar simbólica y físicamente los sistemas campesinos. La combinación de leyes globales y locales limita la autonomía productiva al propiciar cambios que fomentan la dependencia, favorecen la transnacionalización de los sistemas agrícolas y coartan las prácticas campesinas. La nueva ofensiva del capital es “incluir, incorporar, intervenir y transformar individualidades de acuerdo con la lógica del capital” manteniendo ciertas coordenadas de control (Giraldo, 2018, 85). Al presentar el caso del Ecuador, me refiero al papel de las leyes en la evolución, el perfeccionamiento de esos sistemas de inclusión. Se muestra cómo la agricultura por contrato pasó de ser una iniciativa privada a ser parte de la política pública y cómo las normas de semillas, medidas sanitarias y fitosanitaras se han convertido en instrumentos para controlar la producción del alimento - siembra, cultivo, transformación y comercialización- y limitar cualquier opción diferente que se mantenga o surja de la creatividad campesina.
