This analysis requires, as an initial matter, going back to the very nature of things that exist, because for things, entities, to be harmed, they must first exist; this is natural and obvious. Only after we can identify the nature of their existence, we will be in a position to progress in the analysis of the causes and conditions that allow us to verify the existence of harm or damage from which compensation for the accused may or may not arise. This implies investigating the proof of moral harm, its means, requirements, and possibilities. In modern societies, trust in the judicial process is increasingly grounded and dependent on the seriousness and reasonability of evidence; therefore, paying attention to the best resources or possibilities for substantiating facts will result in a better justice system. Reflexionar acerca de la naturaleza del daño moral puede resultar una cuestión harto compleja, puesto que nos plantea la necesidad de indagar sobre los caracteres que encierran y definen a este tipo de entidad que ha sufrido un menoscabo susceptible de reparación o resarcimiento. Este análisis requiere, como cuestión inicial, remontarnos a la naturaleza misma de las cosas que existen, porque para que puedan ser dañadas, las cosas, los entes, primero deben existir, esto es natural y obvio. Recién luego de que podamos identificar la naturaleza de su existencia, estaremos en condiciones de avanzar en el análisis de las causas y condiciones que nos permitan verificar la existencia de un perjuicio o menoscabo del que se derive (o no) un resarcimiento al sindicado como culpable. Esto implica indagar acerca de la prueba del daño moral, sus medios, requisitos y posibilidades. En las sociedades modernas, la confianza en el proceso judicial, se asienta y depende cada vez más de la seriedad y razonabilidad probatoria, por ello reparar en los mejores recursos o posibilidades de acreditación de los hechos, redundara en un mejor sistema de justicia.
