Sumario:This paper analyzes some points of contact between the new contracting trends through online commerce and the functions of Tort Law. After mentioning digital service providers, the study focuses on the platforms that provide online sites to contractual partners. Then, this paper addresses the topic of the functions of Tort Law. Specifically, legal, doctrinal and jurisprudential trends are reviewed in connexion to the responsibility of ecommerce web sites, in the European Union and in Argentina. The issue is approached from the perspective of the measures that should be adopted in the exercise of the preventive function. This study suggests that both the seller and the platform should provide adequate, concrete and effective information to protect the user and consumers´ rights.
