After mentioning digital service providers, the study focuses on the platforms that provide online sites to contractual partners. Then, this paper addresses the topic of the functions of Tort Law. Specifically, legal, doctrinal and jurisprudential trends are reviewed in connexion to the responsibility of ecommerce web sites, in the European Union and in Argentina. The issue is approached from the perspective of the measures that should be adopted in the exercise of the preventive function. This study suggests that both the seller and the platform should provide adequate, concrete and effective information to protect the user and consumers´ rights. El presente trabajo analiza algunos puntos de contacto entre las nuevas tendencias de contratación a través de medios tecnológicos, comercio online, y las funciones del Derecho de Daños. Tras efectuar una mención a los proveedores de servicios digitales, se deslinda el objeto de estudio con énfasis en las plataformas que disponen sitios para la contratación en línea entre usuarios. Luego se abordan conceptos centrales relativos a las funciones del Derecho de Daños. Específicamente se reseñan tendencias legales, doctrinarias y jurisprudenciales –en Unión Europea y en Argentina- en torno a la responsabilidad de dichos sitios web. Se enfoca la cuestión desde la perspectiva de las medidas que se pueden y deben adoptar en ejercicio de la función preventiva. En pos de la protección de los derechos del usuario, se introduce la necesidad de cumplir con una adecuada, concreta y eficaz información por parte del vendedor y del titular del espacio virtual.
