Sumario:The functions of the State and the rights of the citizens are increasingly broad. This leads to the State being sued not only for its actions that cause damage but also for those omissions that cause an impairment to a person's assets. The current trend shows that society's problems are increasingly complex and responses to these needs are expected from the State, which is why this issue becomes more important and topical. This work seeks to investigate when and to what extent the State must respond for the damages caused by its omissions.
