The current trend shows that society's problems are increasingly complex and responses to these needs are expected from the State, which is why this issue becomes more important and topical. This work seeks to investigate when and to what extent the State must respond for the damages caused by its omissions. Las funciones del Estado y los derechos de la ciudadanía son cada vez más amplios. Ello lleva a que se demande al Estado no sólo por sus acciones que provocan daños sino también por aquellas omisiones que provocan un menoscabo en el patrimonio de una persona. La tendencia actual pone de manifiesto que los problemas de la sociedad son cada vez más complejos y se espera del Estado respuestas a esas necesidades, por lo que este tema cobra mayor importancia y actualidad. Este trabajo busca indagar cuándo y en qué medida el Estado debe responder por los daños provocados por sus conductas omisivas.
