Therefore, in this article we analyze under these terms the outdatedness of the Intellectual Property Law (Law 11.723). In order to do so, we make a theoretical journey and focus on two concepts: "intertextuality" (Kristeva, 1978) and "social multilingualism" (Bakhtin, 1989). With these axes in mind, we will analyze a case of accusation of piracy from 2008 and a case of accusation of plagiarism from 2011. The study is related, in turn, to the development of technologies, specifically the Internet. Our hypothesis is that the copyleft movement could contribute elements to the judgment of sentences to be ratified in a judicial process. Finally, we conclude that copyleft responds in a better way to the current needs of the literary field than the current legislation. El presente artículo se circunscribe dentro del ámbito de la lingüística forense, disciplina que puede definirse como el cruce entre la lingüística y el derecho. Entonces, en este artículo analizamos bajo estos términos la desactualización de la Ley de Propiedad Intelectual (Ley 11.723). Para eso, realizamos un recorrido teórico y nos centramos en dos conceptos: “intertextualidad” (Kristeva, 1978) y “plurilingüismo social” (Bajtín, 1989). Teniendo en cuenta estos ejes, analizaremos un caso de acusación de piratería del 2008 y un caso de acusación de plagio del 2011. El estudio se relaciona, a su vez, con el desarrollo de las tecnologías, específicamente de Internet. Nuestra hipótesis es que el movimiento copyleft podría aportar elementos al dictamen de sentencias para que estas sean ratificadas en un proceso judicial. Por último, concluimos que el copyleft responde de una mejor manera a las necesidades actuales del ámbito literario que la legislación actual.
