A la primera pregunta, el enfoque dominante responde aduciendo que el consentimiento vendría a transformar la naturaleza moral de nuestras acciones, justificando lo que de otro modo sería injustificable. Y a la segunda, por su parte, aduciendo que esta transformación sólo ocurre cuando tales acciones encierren un carácter moral negativo. Pues bien, el propósito central que aquí persigo es el de revisar esta doble hipótesis. Como fruto de mi argumentación, no sólo espero demostrar por qué el poder moral del consentimiento no se reduce a su fuerza transformadora, sino también de qué manera ha de interpretarse el carácter moral sobre el que actuaría este poder. Para ello, sin embargo, será necesario adoptar una teoría ética que reconozca el valor del (auto)respeto. Any approach to the justifying power of consent must be prepared to deal with at least the following pair of questions: on the one hand, what consent is supposed to do; and, on the other, when its invocation would be necessary. Regarding the first question, the dominant view has it that consent aims at transforming the moral nature of our actions, justifying what would otherwise be unjustifiable. As regarding the second one, the view claims that such a transformation can only occur in virtue of the morally objectionable features contained in those very actions. The aim of this paper is to address the dominant view’s double hypothesis. As a result of my argument, I expect to shed some light not only on the non-transforming functions that consent would anyway accomplish, but also on how the morally objectionable features contained in those actions must be interpreted for consent to play its distinctive role. In the end, it is the value of (self)respect the one that will offer the main interpretative key.
