It has an empirical basis, compounded by a specific universe of resolutions in which the right to property was discussed, in cases of public-private tension. We will briefly develop Pierre Bourdieu's theory of fields, focused on the legal field and emphasizing the role of judges in it, to finally apply it in what we consider important to the specific cases mentioned above. El presente trabajo puede traducirse como un texto exploratorio, que pretende mostrar una aproximación para comprender la función judicial, desde una perspectiva sociológica, concretamente en el Poder Judicial de la Provincia de Córdoba. El mismo cuenta con una base empírica, consistente en un universo determinado de resoluciones que deciden sobre el derecho de propiedad en conflicto, en casos de tensión público-privado. Desarrollaremos brevemente la teoría de los campos de Pierre Bourdieu, enfocada en el campo jurídico y enfatizando el rol de los jueces en él, para finalmente aplicarla en lo que estimamos importante a los casos concretos antes mencionados.
