This paper analyzes the tension between the system of codified national substantive law and the preservation of provincial jurisdictions in the application of the codes. It seeks to show that, as an effect of these tensions, the dominant interpretation has validated a constitutional assessment in which the organization of jurisdictional powers has greater relevance than the principle of equality before the law, with the consequent postponement of a basic principle of the liberal discourse. El modelo constitucional argentino combina, como se sabe, una estructura política federal con algunos rasgos típicos de los sistemas unitarios. Este trabajo analiza la tensión que se produce entre el sistema de derecho sustantivo nacional codificado y la reserva a favor de las jurisdicciones provinciales en la aplicación de los códigos. Procura mostrar que, como efecto de esas tensiones, la interpretación dominante ha convalidado una ponderación constitucional en la que la organización del poder jurisdiccional tiene mayor relevancia que el principio de igualdad ante la ley, con la consecuente postergación de un principio básico del discurso liberal.
