| Sumario: | The right to be forgotten exercised with limits is an adequate response to safeguard the freedom of digital self-determination, since it allows requires websites, search engines, the deindexation or deletion of information that are no longer necessary for the purpose for which they were treated, for the time elapsed or for being inappropriate, irrelevant.
This right is not absolute, freedom of expression, freedom of the press must prevail when the facts that are revealed deal with matters of general interest or harm the common good.The weighting between the rights involvedrespect for the principle of proportionality should provide the answer. It’s convenient a legal regulation that sets the limits, determines guidelines and establishes mechanisms to facilitate their concretion. |
