This right is not absolute, freedom of expression, freedom of the press must prevail when the facts that are revealed deal with matters of general interest or harm the common good.The weighting between the rights involvedrespect for the principle of proportionality should provide the answer. It’s convenient a legal regulation that sets the limits, determines guidelines and establishes mechanisms to facilitate their concretion. El derecho al olvido ejercido con límites es una respuesta adecuada para resguardar la libertad de autodeterminación digital, ya que permite preservar derechos personalísimos, honor, intimidad, identidad, etc., que hacen a la dignidad de las personas, frente a la lesión que información verdadera y no discriminatoria relativa a ellas, pueda ocasionarles. Faculta a exigir a los sitios web, motores de búsqueda, la desindexación o supresión de información que ya no es necesaria para la finalidad por la que fue tratada, por el tiempo transcurrido o por ser inapropiada, irrelevante. Este derecho no es absoluto, se debe priorizar la libertad de expresión, libertad de prensa, cuando la relevancia pública de la información así lo amerite. La ponderación entre los derechos implicados y el respeto al principio de proporcionalidad debería ofrecer la respuesta.Es conveniente una regulación legal que fije los límites, determine pautas y establezca mecanismos para facilitar su concreción.
