The TSJ has unanimously and jointly resolved to partially accept the appeal, ordering it to be revoked while ordering that the actor be incorporated into the permanent staff of the company due to a job disability quota. However, the Supreme Court held that, within one year from the ruling, EPEC must regulate and implement a selection mechanism, in compliance with the work quota for disability established by Law 5624. In this article I propose to reconstruct the reasoning of the court from a conception of the interpretation of Dworkin, investigating the scope and meaning of the principle of equality thrown by the court and its application in the matter of disability. En 2019 el Tribunal Superior de Justicia de Córdoba (TSJ) ha resuelto acerca del Cupo Laboral Personas con Discapacidad (art. 2, Ley Nº 5624, modificada por la Ley Nº 8834) sobre la base de un recurso de apelación formulado por la parte demandada (EPEC) contra la sentencia que hizo lugar a la acción de amparo promovida por la actora, una persona con discapacidad que pretende ser contratada por la EPEC. El TSJ ha resuelto, por unanimidad y en forma conjunta, hacer lugar en forma parcial al recurso de apelación planteado, ordenando se revoque la misma en tanto resolvió que se incorporara al actor en la planta permanente de la empresa por cupo de discapacidad laboral. Sin embargo, el TSJ sostuvo que, en el plazo de un año desde la sentencia, EPEC debe reglamentar e implementar un mecanismo de selección, en cumplimiento del cupo laboral por discapacidad fijado por la Ley 5.624. En este artículo propongo reconstruir el razonamiento del tribunal desde una concepción de la interpretación de Dworkin, indagando el alcance y sentido del principio de igualdad arrojada por el tribunal y su aplicación en materia de discapacidad.
