| Sumario: | This paper analyzes the use of the rule of clear mistake on criminal decisions taken by Cordoba´s Superior Court of Justice. This rule states that an act can only be disregard when those who have the right to make laws have not merely made a mistake, but have made a very clear one, so clear that it is not open to rational question. The local court takes the rule from a work published by Thayer in 1893. In this lines, we attend to show that the use of the rule made in case «Loyola» is opposite to Thayer’s proposal. |
