This rule states that an act can only be disregard when those who have the right to make laws have not merely made a mistake, but have made a very clear one, so clear that it is not open to rational question. The local court takes the rule from a work published by Thayer in 1893. In this lines, we attend to show that the use of the rule made in case «Loyola» is opposite to Thayer’s proposal. El trabajo aborda el uso del argumento “clara equivocación del legislador” como recurso para declarar la inconstitucionalidad de normas penales de fondo. Este argumento, utilizado por el TSJ al resolver el caso «Loyola», afirma que una ley solo puede ser anulada cuando el legislador ha cometido, no una mera equivocación, sino un error tan claro que no queda abierto a una cuestión racional. El tribunal toma el estándar de un trabajo publicado por Thayer en 1893. Mas, como se demuestra en este trabajo, el uso que hace del argumento en el caso «Loyola» no se corresponde -incluso, se contrapone-  con la doctrina desarrollada en dicha publicación.
