| Sumario: | The aim of this work is to look into the characterizations of the concept of gender violence as an aggravating circumstance to homicide, made by Córdoba’s Superior Court of Justice. To that end, we cast certain relevant cases in which we observe a definition process regarding the concept – which is still imprecise in literature and in its application –. Lizarralde (2017) has been a crucial case as it emerged as the first in Córdoba to include the aggravation of gender violence. Previous cases such as Morlacchi (2014) and Trucco (2016) established the conditions facilitating that resolution. Last, we shall analyze the above-mentioned aggravating circumstance in light of Casiva (2019), which is still under appeal, for it incorporates Argentinian’s gender identity law. We shall examine the dialog between gender regulatory norms and juridical speech, where other concepts underlie, such as gender violence context, interpersonal relationships, emotions, and gendered subjectivation processes. |
