To that end, we cast certain relevant cases in which we observe a definition process regarding the concept – which is still imprecise in literature and in its application –. Lizarralde (2017) has been a crucial case as it emerged as the first in Córdoba to include the aggravation of gender violence. Previous cases such as Morlacchi (2014) and Trucco (2016) established the conditions facilitating that resolution. Last, we shall analyze the above-mentioned aggravating circumstance in light of Casiva (2019), which is still under appeal, for it incorporates Argentinian’s gender identity law. We shall examine the dialog between gender regulatory norms and juridical speech, where other concepts underlie, such as gender violence context, interpersonal relationships, emotions, and gendered subjectivation processes. Este trabajo propone rastrear caracterizaciones del Tribunal Superior de Justicia de Córdoba (TSJ) del concepto de violencia de género en tanto agravante de homicidio. Para ello, recuperamos ciertos fallos relevantes, en los cuales notamos un proceso de definición del concepto – que aún reviste imprecisiones en la literatura y en su aplicación –. El fallo Lizarralde (2017) ha sido crucial en cuanto trascendió como el primero en la Provincia en incluir el agravante por violencia de género, y fallos anteriores como Morlacchi (2014) y Trucco (2016) establecieron algunas de las condiciones que lo hicieron posible. Por último, revisamos el agravante a la luz de la novedad del fallo Casiva (2019), aun en instancia de casación, en cuanto incorpora la Ley de identidad de género. Atenderemos al diálogo entre normas de género y discurso jurídico, en el que subyacen concepciones sobre contexto de violencia de género, relaciones interpersonales, emociones y procesos de subjetivación generizada.
