Particularly, our purpose is to assess the scope of that election, as a necessary step in controlling the justification of judicial decisions. Likewise, we will critically analyze the incorporation of amicus curiae figure as an appropriate dialogical justice´s tool to learn the current paradigms and social imaginaries. Este trabajo tiene por objeto analizar los argumentos que el Tribunal Superior de Justicia dio en el voto mayoritario de la sentencia “Portal de Belén” (2018), para justificar la teoría de la interpretación dinámica a la que adscribe. En particular, se intentará vislumbrar los alcances de la elección que realiza, como un paso necesario en el control de la justificación de las decisiones de nuestras juezas y jueces. Asimismo, analizaremos críticamente la incorporación de la figura de los amicus curiae como una herramienta de la justicia dialógica que permite conocer los paradigmas e imaginarios sociales vigentes.
