Los derechos adquiridos por parte de las mujeres y de la diversidad sexual han despertado dentro de la sociedad grandes controversias y contra reacciones por parte de distintos sectores y actores, dando lugar a disputas y tensiones de derechos que se presentan en un primer momento como opuestos. Una de dichas tensiones que aparecen con más fuerza entre los feminismos y sus detractores, es la que se presenta entre el derecho a la libertad en sus diversas variantes –religiosa, de expresión, de cátedra–, y los derechos de las mujeres y de la diversidad sexual. El objetivo de este artículo es analizar cómo el activismo judicial feminista construye jurídicamente dicha tensión, analizando los distintos argumentos que esgrimen para sostenerla e inclinarla a favor de los derechos de las mujeres y de la diversidad sexual. Para dicho fin, se analizarán comparativamente tres denuncias judiciales/administrativas presentadas por organizaciones de la sociedad civil feministas contra instituciones educativas de diferentes niveles, a causa de los contenidos curriculares presuntamente discriminatorios dictados en ellas. Se indagará sobre los elementos y argumentos en común entre dichas denuncias para desentrañar los debates políticos, institucionales y técnicos-jurídicos que hacen a sus posicionamientos y construcciones sobre los diversos límites al derecho de la libertad. Abstract: The rights acquired by women and sexual diversity have aroused great controversy and counter-reactions within society from different sectors and actors, giving rise to disputes and tensions of rights that are initially presented as opposites. One of these tensions that appears most strongly between feminisms and their detractors is the one between the right to freedom in its various variants -religious, of expression, of teaching-and the rights of women and sexual diversity. The aim of this article is to analyze how feminist judicial activism legally constructs this tension, analyzing the different arguments used to support it and to tilt it in favor of the rights of women and sexual diversity. To this end, three judicial/administrative complaints filed by feminist civil society organizations against educational institutions of different levels, due to the allegedly discriminatory curricular contents taught in them, will be comparatively analyzed. The elements and arguments in common between these complaints will be investigated in order to unravel the political, institutional and technical-legal debates that make up their positions and constructions on the various limits to the right to freedom. info:eu-repo/semantics/publishedVersion Fil: Armando, Sofía.
