This article aims to show why this case is neither a precedent of preventive self-defense nor a precedent of self-defense. The conclusion is that the case Caroline is to be revaluate as a precedent of international necessity and not as one of self-defense, on the ground of the absence of a state as active subject, that execute an armed attack in the sense of the legal institution of the international self-defense. La parte de la doctrina internacional que argumenta a favor de la existencia de un derecho a legítima defensa preventiva en el derecho internacional, invoca el caso Caroline como su precedente. Este artículo tiene por finalidad demostrar por qué este caso no constituye ni un precedente de legítima defensa preventiva ni un precedente de legítima defensa. El resultado demuestra que el caso Caroline debe ser revalorado como un precedente de estado de necesidad internacional y no de legítima defensa, sobre la base de la ausencia de un Estado como sujeto activo que ejecute un ataque armado a los fines del instituto jurídico de la legítima defensa internacional.
