In part, it sealed its proceedings, and by the reluctance of courts to accept figures that are often excluded from the arbitration procedures established. Los alcances del amicus curiae como una figura procesal de participación de sujetos, diferente a las posiciones de las partes, ha tenido en forma progresiva, un auge en la práctica en los tribunales nacionales e internacionales. Dentro del sistema arbitral sobre inversión extranjera, son pocas las oportunidades en las que se ha usado esta figura de origen romano. En parte, por lo hermético de los procesos arbitrales y por la reticencia de los tribunales en aceptar figuras que suelen estar excluidas de los procedimientos pautados del arbitraje.
