The idea of whether to appeal only to the provisions of law, or if they can or must make moral judgments to find the best solution to the case involved is one of the most discussed topics in professional ethics. In this paper, I describe the different ethical theories developed around this problem, and also show how this are linked to different conceptions about what is the law. For this, I consider these visions briefly, focusing specifically on ideological positivism and legal formalism, the natural or substantivist law and inclusive positivism. Thus I conclude that the answer taken to the moral dilemma that is presented to the advocates, depends on the ethical and legal standard that each of us assume. En el ejercicio profesional los abogados defensores se encuentran muchas veces frente a dilemas morales de cómo deben actuar ante un caso complejo. La idea de si debe recurrir sólo a lo dispuesto en la ley, o si puede o debe realizar juicios morales en busca de la mejor solución al caso en el que interviene, es uno de los temas más discutidos en la ética profesional. En este trabajo describo las distintas teorías éticas desarrolladas en torno a este problema, y además, muestro como éstas, están vinculadas a las distintas concepciones acerca de qué es el Derecho. Para ello, desarrollo brevemente estas visiones, centrándome específicamente en el positivismo ideológico y el formalismo jurídico, el iusnaturalismo o sustantivismo, y el positivismo incluyente. De esta forma concluyo en que la respuesta que se adopte al dilema moral que se les presenta a los abogados defensores, depende de la concepción ética y de Derecho que cada uno de nosotros asuma.
