We highlight the differences between the different projects and make a critical analysis of them in order to clarify the basis on which is now possible to support the international responsibility of States for lack of due diligence. Este trabajo analiza la cuestión de la responsabilidad internacional del Estado por falta de diligencia debida, aspecto que no quedó resuelto en el marco del Proyecto de la Comisión de Derecho Internacional de Naciones Unidas (CDI) sobre responsabilidad de los Estados por hechos internacionalmente ilícitos (2001). Destacamos las diferencias existentes entre los distintos proyectos y realizamos un análisis crítico de ellas con el objeto de poder precisar sobre la base de qué artículos de dicho Proyecto, es posible actualmente sustentar la responsabilidad internacional del Estado por falta de diligencia debida.
