Omar Palermo, taking his reasoning, criticizes him and affirms that he must have concluded that it is a cause of atypicality. This work exposes the two positions and the motives that guarantee that the defensive action creates a typical risk and that your injury should not be objectively attributable to the scope of the aggressor-victim. Illegitimate aggression and defensive action must be legally assessed in their respective fields of competence. In this sense, although the omission of the duty of rescue by the aggressor is true, it ceases to be guarantor in the face of the defensive reactionand opens the way to the duty of tolerance. En el funcionalismo radical, Günther Jakobs presenta a la legítima defensa como una causa de justificación, considerando quela acción defensiva es típica pero no antijurídica. Omar Palermo, tomando sus razonamientos, lo critica y afirma que debió concluir que es una causa de atipicidad. Este trabajo expone las dos posiciones y los motivos que avalan sostener que la acción defensiva crea un riesgo típico y que su lesión no debe ser imputable objetivamente al ámbito de organización del agresor-víctima. La agresión ilegítima y la acción defensiva, deben ser valoradas jurídicamente en sus respectivas esferasde competencia. En tal sentido, aunque es cierta la omisión del deber de salvamento por parte del agresor, éste deja de ser garante ante la reacción defensiva y se abre paso al deber de tolerancia.
